Terms of Service
1. Acceptance and use of the App
These Terms of Service (“Terms”) are an agreement between you and Jayanth Krishna Dharan Khannan, an individual developer based in India (“we,” “us,” “our”) governing your use of Carcino (“the App”). By downloading or using the App, you agree to these Terms and our Privacy Policy (carcino.app/privacy-policy/). If you do not agree, do not use the App.
Eligibility. You must be at least 18 years old to use the App. By using it, you confirm that you are 18 or older.
License. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, for your personal, non-commercial use, in line with these Terms and Apple’s App Store Usage Rules.
Availability. The App is not offered in the European Union, European Economic Area, or United Kingdom.
2. Health and information disclaimer
The App is for general information only. It is not medical, nutritional, or professional advice. Scan results are not a diagnosis and are not a substitute for advice from a doctor, dietitian, allergist, or other qualified professional. Always talk to a qualified professional about your health, diet, allergies, or any medical condition. Never ignore professional advice or delay seeking it because of something you saw in the App.
Results may be incomplete or wrong. Ingredient information comes from product labels, manufacturers, public databases, and third-party sources that may be outdated, incomplete, or inaccurate. Products and recipes change, and a scan may misidentify a product or miss an ingredient. Always read the product’s actual label.
How ingredients are flagged. When the App identifies an ingredient as a possible carcinogen or as toxic, it relies on classifications from these sources: the World Health Organization’s IARC Monographs, the U.S. National Toxicology Program’s Report on Carcinogens, California’s Proposition 65 list, and the U.S. Environmental Protection Agency’s Integrated Risk Information System (IRIS). These classifications often reflect hazard under certain conditions and doses, not proven risk from normal consumption. A flag does not mean a product will harm you, and the absence of a flag does not mean a product is safe.
Allergies and emergencies. Do not rely on the App to detect allergens or decide whether a product is safe for someone with an allergy or medical condition. If you think you or someone else has been harmed by a product, contact your local emergency number right away (for example, 112 in India) or a poison control center.
No statements about brands. Results describe ingredients, not the overall quality, legality, or safety of any brand or product, and do not imply endorsement by or affiliation with any manufacturer.
3. Acceptable use, ownership, and Apple
Acceptable use. You agree not to:
Copy, scrape, or bulk-extract the App’s product or ingredient data
Reverse engineer, decompile, or modify the App, except where the law allows
Use the App for any unlawful purpose or to violate anyone’s rights
Interfere with the App’s security or operation, or overload its servers
Use automated tools or bots to access the App
Present App results as professional, medical, or certified testing results
Ownership. The App, including its software, design, text, graphics, and compiled product and ingredient data, is owned by us or our licensors and protected by intellectual property laws. Except for the license above, these Terms give you no rights in it. If you send us feedback or suggestions, we may use them freely without paying you.
Third-party content. The App may show data from or links to third parties. We are not responsible for their content, accuracy, or practices.
Apple App Store terms. These Terms are between you and us only, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
4. Disclaimer of warranties and limitation of liability
No warranties. THE APP AND ALL RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RESULT IS ACCURATE, COMPLETE, OR CURRENT.
Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ILLNESS, OR LOSS ARISING FROM YOUR USE OF OR RELIANCE ON THE APP OR ITS RESULTS, INCLUDING DECISIONS ABOUT WHAT TO BUY OR CONSUME. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.
Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. In that case, our liability is limited to the fullest extent the law allows.
5. Indemnity, termination, and disputes
Indemnity. You agree to defend and hold us harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the App or your violation of these Terms or anyone’s rights.
Termination. You may stop using the App at any time by deleting it. We may suspend or end your access, or change or discontinue the App, at any time and for any reason. Sections 2 through 5 survive termination.
Governing law. These Terms are governed by the laws of India, without regard to conflict-of-law rules. If you live in another country, the mandatory consumer protection laws of that country still apply to you.
Disputes. Before filing a claim, you agree to contact us at contact@carcino.app and try to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought only in the courts located in Coimbatore, Tamil Nadu, India, and you consent to their jurisdiction, except where the law of your country gives you the right to bring a claim where you live.
6. Changes and contact
Changes. We may update these Terms from time to time. We will post the new version in the App and at carcino.app/terms-of-use/ and update the “Last updated” date. Continuing to use the App after changes take effect means you accept them.
General. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the App. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition, or sale of assets.
